Road Occupancy Permit

A Road Occupancy Permit is required prior to commencing any work, project or bin storage located within the Town’s road allowance (i.e., boulevard, sidewalk, and/or roadway). You cannot work or store material without first obtaining a permit, as per Bylaw 35-2020. We evaluate each location individually. Bins and pods must be placed in driveways if possible instead of applying for a permit.

Please note that the Town will not issue a permit for work within a Regional Road allowance. It is the applicants responsibility to verify the roads jurisdiction before submitting. Refunds will not be issued for application's submitted.

Important Information:

  1. Road Occupancy Permit applications will not be approved for unassumed road allowances without approval from the developer.
  2. The Town requires a minimum of 10 business days to review an application once submitted (5 days for storage).
  3. Work (not including storage) is not permitted during rush hour period (7:00 AM to 9:00 PM, or 4:00 PM to 6:00 AM) on the travelled portion of the roadway.
  4. Proof of liability insurance ($5,000,000 minimum) naming the Town of Milton as additional insured is required. A Certificate of Insurance must be submitted with the permit application. Without valid proof of insurance, this application will not be processed and a permit will not be issued.
  5. Final placement of bin/pod to be determined by the Town, and no lose materials are permitted on the roadway.

Fees per permit type:

  • Storage - $243
  • All other - $887

A minimum of one (1) inspection fee of $501 plus applicable taxes will apply to all permits (not including storage). The number of inspections required will be determined through the review of the application.

  • This permit does not constitue site plan, M.C. and/or service connection approval.
  • Town Permit Inspector must be notified atleast 48 hours prior to commencement of work or this permit is not valid.
  • Failure to comply with all conditions will void this permit.

General Terms & Conditions

 All work carried out within the Town’s road allowance must be completed in accordance to the Town of Milton Restoration Standards and to the satisfaction of the Town of Milton.

  1. Prior to commencing any excavation operations, the Applicant must obtain the necessary locates or clearances as required by the Ontario Underground Infrastructure Notification System Act, 2012.
  2. All changes and/or deviations from the approved plans and/or location shall be subject to re-approval by the Town of Milton.
  3. Surrounding property owners and/or residents shall receive a minimum of 24 hours written notice prior to commencing work, unless an emergency.
  4. The applicant agrees and accepts full responsibility to supply, maintain, clean and place all barricades, warning signs, delineators, and flashing lights, necessary for the protection of the public and the safe operation of the installation, at the applicant's own expense, as per the Ontario Traffic Manual (OTM), Book 7, Temporary Conditions latest revision. (Note: This manual depicts minimum standards, additional signing may be required)
  5. The Applicant agrees that they have reviewed By-Law No. 35-2020 and further that the Applicant will comply with all requirements set out in that By-Law
I have read, understood, and will comply to the attached General Terms & Conditions which form part of this permit application.
 

Indemnity Agreement

The applicant hereby covenants and agrees, that in return for and as a condition of issuing of a permit, the applicant shall indemnify, defend and save harmless the town from and against any and all actions, causes of action, suits, claims, demands, losses, liabilities and costs that the town may suffer or incur arising by reason of the applicant or the applicant’s agents, household members, employees, contractors or anyone else acting on the applicant’s behalf:

  1. Doing anything the applicant is permitted or required to do under the terms of the permit;
    Failing to do, incorrectly doing or negligently doing anything the applicant is permitted or required to do under the terms of the permit; or
  2. Doing anything within the town’s road allowance that is not permitted under the terms of the permit or applicable town’s by-laws.
  3. The applicant further acknowledges and agrees that the town makes no warranty as to fitness of purpose of the town road allowance for the entrance or road occupancy intended by the applicant and that is the applicant’s obligation to satsify itself that fitness of purpose and to conduct all investigations, locates and studies necessary to undertake the work permitted by a permit issued by the town.

The applicant further acknowledges and agrees that the town is not liable to the applicant for any deficiency in the entrance or road occupancy howsoever caused or any alteration, repair or removal of any entrance or road occupancy in accordance with town by-law 035-2020.
