Curb Cut and Entrance Permit

A permit is required prior to making any modifications to an existing entrance or construction of a new entrance within the Town of Milton's road allowance, as per Bylaw 35-2020

Please note that the Town will not issue a permit for work within a Regional Road allowance. It is the applicants responsibility to verify the roads jurisdiction before submitting. Refunds will not be issued for applications submitted.

Important Information:

  1. Please note that if your subdivision was registered on or after roughly year 2000, there will be a warning clause registered on title for your lot stating that entrance modifications are not permitted.
  2. The Town requires a minimum of 10 business days to review an application once submitted.
  3. All applications require a site visit prior to approval to check for constructability and distance from obstructions. Applicant will be contacted by the Town if there are any issues preventing the approval of this application.
  4. Curb Cut and Entrance Permit review will be performed between April 1 and October 31. Applications submitted outside these dates will be deferred. Applications submitted close to the end of season may be deferred at the Town’s discretion.
  5. Driveways are to be 1.2 m clear of utility and municipal infrastructure (catchbasins, fire hydrants, street lights, street trees, etc.).

Town Standards:

All proposed entrances and entrance modifications must be in line with Town Standards as defined below. Please refer to the Zoning Bylaw for maximum driveway widths.

“Town Standards” means those standards, requirements and specifications set out in the Town’s Engineering and Parks Standards Manual and Right of Way Construction Standards Manual as may be amended from time to time and all other applicable policies and by-laws of the Town as may be amended from time to time, including without limitation, applicable zoning by-laws;

Please note the following application fees for the review of the submission. There is no guarantee of approval with this fee.

Fees per permit type:
  • Residential - $634
  • Non Residential - $1,893
A minimum of one (1) inspection fee of $501 plus applicable taxes will apply to all permits. The number of inspections required will be determined through the review of the application.

General Terms and Conditions

  1. An application shall expire three (3) months after the date of submission if the Applicant has failed to respond or submit payments.
  2. The permit shall expire three (3) months after the date of issuance if the work, which is the subject of the Permit, has not commenced within that time. After expiration of the three (3) month term, a new Permit must be obtained before proceeding with such work.
  3. The Town of Milton will not accept responsibility for any damages to private sprinkler/irrigation heads, systems or other fixtures encroaching on Town property when performing works approved under Bylaw 35-2020.

Indemnity Agreement

The applicant hereby covenants and agrees, that in return for and as a condition of issuing of a permit, the applicant shall indemnify, defend and save harmless the Town from and against any and all actions, causes of action, suits, claims, demands, losses, liabilities and costs that the Town may suffer or incur arising by reason of the applicant or the applicant’s agents, household members, employees, contractors or anyone else acting on the applicant’s behalf:

  1. Doing anything the applicant is permitted or required to do under the terms of the permit;
    Failing to do, incorrectly doing or negligently doing anything the applicant is permitted or required to do under the terms of the permit; or
  2. Doing anything within the Town’s road allowance that is not permitted under the terms of the permit or applicable Town’s by-laws.
  3. The applicant further acknowledges and agrees that the Town makes no warranty as to fitness of purpose of the Town road allowance for the entrance or road occupancy intended by the applicant and that is the applicant’s obligation to satisfy itself that fitness of purpose and to conduct all investigations, locates and studies necessary to undertake the work permitted by a permit issued by the Town.

The applicant further acknowledges and agrees that the Town is not liable to the applicant for any deficiency in the entrance or road occupancy howsoever caused or any alteration, repair or removal of any entrance or road occupancy in accordance with Town by-law 035-2020.
